Sleep Sound: Relax White Noise Service Terms

Welcome to Sleep Sound: Relax White Noise ("the App"). These Service Terms ("Terms") govern your access to and use of the App, including all features, services, and content provided by Sleep Sound. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

This Terms and Conditions only grants you the right to use the Sleep Sound to benefit from Services within the scope defined herein. You’re not allowed to copy, or modify the Sleep Sound, any part of the Sleep Sound, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the Sleep Sound, and you also should not try to translate the Sleep Sound into other languages, or make derivative versions.

1. App Features and Services

• White Noise and Sleep Sounds: The App provides various white noise and sleep sounds to help you relax and improve your sleep quality.

• Updates and Maintenance: Sleep Sound reserves the right to update, modify, or discontinue the App or any of its features at any time without prior notice.

2. Privacy Policy

• Data Collection: Sleep Sound may collect certain information, including personal data, to improve the App and provide better services. We will use your data in accordance with our Privacy Policy, which is available on the App.

• Data Usage: Your data will not be sold or shared with third parties without your explicit consent, except as necessary to provide the services or comply with legal obligations.

3. Disclaimer of Warranty

• No Guarantees: Sleep Sound provides the App "as is" and makes no guarantees regarding the results of using the App. We are not responsible for any claims, damages, or losses arising from your use of the App.

• Medical Advice: The App is not a substitute for professional medical advice. If you have any medical concerns, consult a healthcare professional.

We only provide services to enable users to set goals and reminders on their intended lifestyle, and to monitor progress towards their intended lifestyle goals. We make no guarantees or promises in relation to the level of progress you may experience.

Our Services are not intended, prepared, developed or implied to be used for the diagnosis, prevention or treatment of any illness, disease or condition, or to be a substitute for medical advice, medical care or psychological counselling.

Using the Services or any other communication from us does not create or imply a medical professional/health care provider-patient relationship whatsoever (e.g. doctor-patient or psychologist-patient relationship).

Sleep sound does not and is not obliged to provide emergency services of any kind. There is no obligation for us to contact you or anyone else regarding your medical or health condition or their treatment. In the event of a medical emergency, you should call your local emergency service.

We recommend that you always consult a professional health care provider if you have any questions about your health, medical or mental condition.

You should never disregard, avoid or delay seeking professional medical care and advice because of anything you have read or obtained through the Services.

You should immediately consult a professional health care provider if you have or suspect that you may have a medical condition or a mental health concern.

4. SUBSCRIPTIONS & PURCHASES

a) Free Trials

You may be eligible for a complimentary trial period for select products or services ("Free Trial"). Each user is entitled to only one Free Trial, regardless of the subscription method used. Sleepsound reserves the right to determine Free Trial eligibility, which may vary depending on factors such as the chosen product/service and prior Free Trial redemptions.

Free Trials will automatically convert to a paid annual or monthly subscription after the trial period ends. To avoid automatic conversion, you must cancel your subscription before the trial expires.

b) Auto-Renewing Subscriptions

Sleepsound offers subscription-based access to its products and services ("Subscription"). Subscriptions are available in monthly or annual terms ("Subscription Term"), where:

1 month = 30 calendar days

1 year = 365 calendar days

Subscriptions may be billed separately for individual products/services. Upon activation, you authorize Sleepsound to charge your account for all accrued subscription fees ("Subscription Fee") on or before the due date.

Your initial payment will be processed on the Subscription Billing Date (the date you first subscribe) and will cover all applicable fees and taxes for the upcoming subscription period. The subscription will continue unless:

You cancel it before renewal, or Sleepsound terminates it, or Your account is deactivated.

c) Cancelling a Subscription

You may cancel your subscription at any time, but you must cancel before the renewal date to avoid being charged for the next subscription term.

d) No Refunds for Subscriptions

Partial subscription terms are non-refundable. Payments will be processed using the payment method provided during registration (or an updated method if changed) ("Payment Method").

You will only have access to Sleepsound’s products and services while your subscription remains active.

5. Content Copyright and Usage Restrictions

a)Copyright Ownership

All audio content, software, design elements, trademarks, logos, and other materials provided through the Sleepsound app ("Content") are the exclusive property of Sleepsound or its licensed partners and are protected under copyright, trademark, and other intellectual property laws.

b)Permitted Use

You may:

Stream or download Content solely for personal, non-commercial use within the Sleepsound app.

Access Content subject to your active subscription or as permitted by a free trial.

c)Prohibited Actions

You may not:

Reproduce, distribute, modify, translate, or create derivative works based on the Content (e.g., sharing, reselling, or uploading to third-party platforms).

Use Content for public performances, broadcasting, or commercial purposes without prior written authorization from Sleepsound.

Remove, alter, or circumvent any copyright notices, watermarks, or technical protections embedded in the Content.

Transfer, sublicense, or lease Content to third parties.

d)User Responsibilities

You agree to:

Refrain from infringing Sleepsound’s intellectual property rights or assisting others in doing so.

Report any unauthorized use of Content to Sleepsound immediately via sleepsound_whitenoise@outlook.com.

e)Legal Consequences

Violations of these terms may result in:

Immediate termination of your account and access to Sleepsound.

Legal action, including claims for damages, injunctions, and statutory penalties under applicable copyright laws.

6. Limitation of Liability

• General Limitation: Sleep Sound and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the App.

• Maximum Liability: In no event shall Sleep Sound's liability exceed the amount you paid for the App or its services.

7. Termination

• Right to Terminate: Sleep Sound reserves the right to terminate your access to the App at any time, with or without cause, and with or without notice.

• Your Responsibilities: Upon termination, you agree to cease all use of the App and to destroy any copies of the App in your possession.

8. Dispute Resolution

• Grievance Redressal: If you have any complaints or disputes regarding the App or these Terms, please contact our customer support team at sleepsound_whitenoise@outlook.com.

9. Modifications to Terms
